Terms and Conditions for Report A Migrant

These Terms and Conditions (“Terms”) are a binding agreement between you (“User,” “you,” or “your”) and Report A Migrant (“Report A Migrant,” “RAM,” “we,” “us,” or “our”). By accessing, using, or submitting through our website, portals, or any related features (the “Services”), you agree to these Terms. If you do not agree, you must immediately discontinue use.

1. Definitions

  • “Services”: The Report A Migrant website, platforms, submission forms, payment processing, and all related features.
  • “Submission”: Any content, data, files, documents, or materials you provide.
  • “Verification Fee”: The mandatory payment required to process a Submission.
  • “Forwarding Entities”: Government agencies (e.g., U.S. Immigration and Customs Enforcement), employers, landlords, organizations, or other third parties to whom Submissions may be delivered.

2. Eligibility & Restrictions

  1. You must be 18 or older and legally competent to enter into contracts.
  2. Use of the Services is prohibited where restricted by law.
  3. We reserve the right to deny, suspend, or revoke access to anyone for any reason.

3. Nature of Services

  1. Report A Migrant is a privately operated, civilian-led reporting channel.
  2. We are not a government agency and make no guarantee of investigation, enforcement, or outcome.
  3. Forwarding of Submissions is at our sole discretion and may include redaction or formatting.

4. User Submissions & False Reports

  1. You are solely responsible for your Submission.
  2. By submitting, you affirm the Submission is accurate to the best of your knowledge and free from malicious intent.
  3. Prohibited Submissions include:
    • False, fabricated, or misleading reports;
    • Defamatory, harassing, or abusive content;
    • Unauthorized use of copyrighted or proprietary materials;
    • Malware, spyware, or any malicious code.
  4. Knowingly false reports may be forwarded to law enforcement; you may be held civilly and criminally liable.
  5. All Submissions, including unpaid or incomplete ones, may be retained in permanent archives subject to our Privacy Policy.

5. Payments & Fees

  1. Each Submission requires a non-refundable Verification Fee unless otherwise mandated by law.
  2. Payments are handled by third-party processors. RAM is not liable for errors, delays, or breaches by such processors.
  3. Chargeback abuse or fraudulent payments may be reported to law enforcement or collection services.

6. License & Ownership of Submissions

  1. By submitting, you grant RAM an irrevocable, perpetual, worldwide, royalty-free license to collect, reproduce, transmit, store, disclose, forward, and otherwise process the Submission for the purposes of the Services.
  2. You waive any claims of ownership or control once submitted, subject to non-waivable rights under applicable law.
  3. We may redact, edit, or format Submissions prior to forwarding.

7. Intellectual Property

  1. All branding, software, design, text, logos, graphics, and functionality are owned by RAM or its licensors.
  2. Unauthorized reproduction, scraping, framing, data mining, or reverse engineering is prohibited.
  3. We comply with the DMCA. Copyright owners may issue takedown requests as provided by law.

8. Prohibited Conduct

  • Use the Services for illegal, defamatory, hateful, or abusive purposes.
  • Impersonate any person or misrepresent your affiliation.
  • Exploit, resell, or commercially use the Services without written authorization.
  • Attempt to gain unauthorized access to systems, networks, or data.

9. Privacy & Data Disclosure

  1. Your use of the Services is governed by our Privacy Policy (incorporated by reference).
  2. We may disclose records, Submissions, and user data in response to lawful subpoenas, court orders, or governmental requests.
  3. Anonymity is not guaranteed; payment records and IP addresses may be linked to Submissions if required by law.

10. No Warranty

  1. The Services are provided “as is” and “as available.”
  2. We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
  3. We do not warrant:
    • (a) the accuracy or completeness of Submissions;
    • (b) any action or inaction by Forwarding Entities;
    • (c) uninterrupted, timely, secure, or error-free operation.

11. Limitation of Liability

  1. To the maximum extent permitted by law, RAM shall not be liable for:
    • Any reliance on Submissions;
    • Actions taken or not taken by Forwarding Entities;
    • Damages from delays, errors, data loss, or service interruptions;
    • Indirect, consequential, incidental, special, or punitive damages.
  2. If liability cannot be fully disclaimed, total damages shall not exceed the lesser of:
    • (a) the Verification Fee paid for the relevant Submission, or
    • (b) $50 USD.

12. Indemnification

You agree to indemnify, defend, and hold harmless RAM and its officers, directors, employees, contractors, and agents from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising from: (i) your use of the Services; (ii) your Submissions; (iii) your violation of these Terms; or (iv) your infringement of third-party rights.

13. Dispute Resolution & Arbitration

  1. All disputes shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its applicable rules.
  2. Venue and seat of arbitration: Texas, USA.
  3. You waive any right to jury trial and class actions.
  4. Arbitration costs shall be shared equally unless otherwise ordered by the arbitrator.

14. International Use

  1. The Services are controlled and operated from the United States.
  2. Users accessing from outside the U.S. are responsible for compliance with their local laws.

15. Force Majeure

We are not liable for delays or failures caused by circumstances beyond our reasonable control, including natural disasters, war, terrorism, civil unrest, cyberattacks, pandemics, labor disputes, utility failures, or government restrictions.

16. Termination

  1. We may suspend or terminate the Services, or your access to them, at any time and without notice.
  2. Termination does not affect provisions relating to Submissions, intellectual property, payments, limitation of liability, indemnification, or dispute resolution.

17. Record-Keeping & Evidence

  1. Submissions and related metadata may be logged, timestamped, and archived for compliance, auditing, or security purposes.
  2. We may provide such records as evidence in legal, regulatory, or investigative proceedings as permitted by law.

18. Compliance & Non-Discrimination

  1. Users must comply with all applicable laws and refrain from using the Services to harass, threaten, or discriminate against any individual or group.
  2. We may refuse, redact, or forward Submissions that appear to promote violence, hate, or illegal activity.

19. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.

20. Severability

If any provision is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.

21. Waiver

Failure to enforce any provision shall not constitute a waiver of that or any other provision.

22. Assignment

You may not assign or transfer these Terms or any rights herein. RAM may assign its rights and obligations without restriction.

23. Survival

Sections relating to Submissions, Payments, Intellectual Property, Indemnification, Limitation of Liability, Records, and Arbitration survive termination.

24. Entire Agreement

These Terms and the Privacy Policy constitute the entire agreement between you and Report A Migrant regarding the Services and supersede all prior or contemporaneous understandings.
